This promotion is intended for participation in the 50 United States and the District of Columbia (“D.C.”). You may not enter if you are not a legal resident of and located in the 50 United States or D.C. and age of majority age in your state of residence as of date of entry.
To enter the Classic Foods “March Mayhem Give Away” sweepstakes online, go to www.classicfoods.com and click the “Click to Win” button on the home page. Follow the instructions for completing the online entry form and entering the Contest. Online entry begins at 12:01 AM Pacific Standard Time ("PST") on March 1st, 2010 and ends online at 11:59PM (PST) on March 31st, 2010 ("Promotion Period”). Entries must be submitted by 11:59PM (PST) March 31st, 2010. Limit one (1) entry per person or household.
Winners will be selected in a random drawing from among all eligible entries received. 1 random drawing will be held March 31th, 2010. Drawings will be conducted by Classic Foods, whose decisions shall be final on all matters related to this Sweepstakes. Odds of winning depend on the total number of eligible entries received.
If you are a selected winner, Classic Foods will mail one (1) case of Kettle Classics® 5oz potato chips (total of fifteen (15) five ounce (5 oz) bags: all flavors. Five winners will be selected. Approximate retail value ("ARV"): USD $36.00. No substitution, transfer or cash redemption of prize is permitted.
Sweepstakes is open to legal residents of the 50 United States, the District of Columbia (D.C.) and Canada. Employees of the Classic Foods, its parent company, affiliates, subsidiaries, agents, retailers, advertising and promotion agencies, and members of the immediate families or households of any of the above are NOT eligible to participate. For purposes of these rules, "immediate families" means parents or legal guardians, siblings, and children.
Classic Foods will notify Winners by email. Winners will be will be required to give a physical street address where the prize can be sent (Prize cannot be sent to a P.O. Box). Failure of a prospective winner to comply with this claim requirement for any reason, or any of these Official Rules, including but not limited to the return of any prize notification, the prize being undeliverable, or the determination that any winner is ineligible to receive such prize, will result in forfeiture of the corresponding prize. If the prize is forfeited for any reason, an alternate winner may be drawn at random from the remaining eligible entries and awarded the prize. Classic Foods reserves the right to substitute a prize of equal or greater value should the featured prize not be available for any reason. In the event of a dispute as to the identity of an online entrant, online entries will be deemed made by the authorized account holder of the e-mail address submitted at time of entry. The authorized account holder is the natural person assigned to the e-mail address by an internet access provider, online service provider, or other organization responsible for assigning e-mail addresses. Prize must be accepted as awarded. Except where prohibited by law, acceptance of any prize constitutes permission to use a winner's name, hometown, likeness, photograph, statements made by the winners about the promotion and/or prize information for advertising and publicity purposes in all media worldwide without limitation and without additional compensation. By participating, participants agree to abide by and be bound by these official rules and Classic Foods decisions, which are final in all matters relating to this Sweepstakes. By accepting a prize, winner agrees to release Classic Foods, its parent company, affiliates, subsidiaries, directors, officers, employees, and agents, from any and all liability for any injuries, losses, or damages of any kind resulting from or in connection with accessing the sweepstakes web site, submitting any entry or otherwise participating in any aspect of the sweepstakes, the receipt, ownership or use of any prize awarded. Classic Foods reserves the right, in its sole discretion, to cancel, suspend, or modify the online entry portion of the Sweepstakes, should a virus, bug, tampering or other causes beyond the control of Classic Foods corrupt the administration, security or proper operation of the Sweepstakes. In the event that the online entry is cancelled during the Promotion Period, prizes will be awarded from among all eligible, non-suspect, online entries received as of the time/date that the online entry portion of the Sweepstakes was terminated. Classic Foods assumes no responsibility or liability for any incorrect or inaccurate entry information, or for any unauthorized access to, or theft, destruction or alteration of entries at any point in the operation of this Sweepstakes. Classic Foods and its agencies are not responsible for computer system, electronic transmission, phone line, hardware, software, or program malfunctions, or other errors, failures or delays in computer transmissions or network connections or Sweepstakes play that are human or technical in nature. Classic Foods reserves the right, at its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or falsifying entry or verification information. Any individual’s use of robotic, automatic, programmed or similar entry methods will void all entries by that individual. Classic Foods reserves the right to disqualify entrants who violate any of the official rules, or attempt to interfere with the promotion in any manner. Any attempt by an entrant to deliberately damage the web site or undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil laws and should such an attempt be made, Classic Foods reserves the right to seek remedies and damages (including but not limited to attorney’s fees) from any such entrant to the fullest extent of the law, including criminal prosecution. Information gathered through this promotion may be used for marketing purposes by Classic Foods.
Except where prohibited by law, all issues concerning the construction, validity and enforcement of these Official Rules, or the rights and obligations of the entrant and Classic Foods, shall be construed and governed by the laws of the state of California, without regard to conflicts of law. All suits or claims brought in connection with this Sweepstakes must be brought in a state or federal court in Orange County, California.
